- Description: EPA proposed reallocating 100% of the additional 770 million RINs exempted from 2025 RFS obligations, either split evenly across 2026 and 2027 or placed entirely in 2027. It may also extend the 2026 compliance reporting deadline. Comments are open until 4 December.

The US Environmental Protection Agency has proposed revisions to its Renewable Fuel Standard (RFS) "Set 2" rule that would reallocate 100% of the additional 2025 small refinery exemption (SRE) volumes into future compliance years, so that the waived volumes are not lost to the biofuel market. EPA Administrator Lee Zeldin announced the proposal in Peosta, Iowa, and described the aim as keeping the rule's record volumes intact and increasing target markets for American farmers.

### What the Proposal Responds To

When EPA finalised the Set 2 rule, it estimated how many hardship exemptions small refineries would receive for their 2025 obligations. The 31 August 2026 SRE decisions exceeded that estimate: about 1.76 billion renewable identification numbers (RINs) were exempted in total, of which an additional 770 million RINs worth of renewable fuel exceeded EPA's projection. The proposal would reallocate that additional 770 million RINs in full.

### Two Options, One Difference

Both proposed approaches reallocate 100% of the difference between projected and actual 2025 exemptions. They differ only in timing. The first would divide the additional volume equally between the 2026 and 2027 compliance years. The second would place all of it in the 2027 compliance year. The proposal also notes the revision to the 2026 standards may extend the existing 2026 compliance reporting deadline of 31 March 2027.

### The Rule Behind It

The Set 2 rule was announced on 27 March 2026 and sets the highest renewable fuel volumes in the history of the RFS programme. EPA estimates the final rule would generate over US$10 billion for rural economies and create more than 100,000 jobs in agricultural and manufacturing sectors.

### Reaction in the Announcement

The release carries statements from Agriculture Secretary Brooke Rollins and Republican lawmakers from Iowa. Rollins described the proposal as a path to 100% reallocation by 2027 and said the biofuel industry supports over 100,000 jobs and more than US$100 billion in economic activity. Senator Chuck Grassley said biofuels directly employ 31,000 people in Iowa. Senator Joni Ernst said reallocating the waived volumes into the 2026 and 2027 obligations would strengthen the farm economy. Representatives Ashley Hinson, Mariannette Miller-Meeks and Zach Nunn also welcomed the proposal, with Hinson saying it reflects a 100% reallocation agreement she helped secure in August. The release includes no reaction from refiners; when the exemptions were announced on 31 August, the American Petroleum Institute opposed shifting the exempted obligations onto larger refiners in future years.

### Process and What Remains Open

EPA will take public comment on the proposal until 4 December 2026\. Because it is a proposal, neither the choice between the two options nor the reporting-deadline extension is final, and the release does not say when a final rule is expected or discuss the effect on RIN prices or on refiners' compliance costs.
